Terms of Service.

1. The agreement

These Terms are an agreement between you and AnimSpark (“AnimSpark”, “we”, “us”). They cover animspark.com, the AnimSpark web app, AnimSpark for Mac, share links, our API and related services (the “Service”). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you use the Service for an organisation, you accept these Terms on its behalf and confirm you have authority to do so. “You” then means that organisation too.

2. The Service

AnimSpark is an AI video agent. You describe a film, and the agent writes, designs, animates, voices, scores and edits it, then lets you change anything. You can use it in a browser, in AnimSpark for Mac, from a coding agent you connect to the Mac app, or through our API.

We're constantly improving the Service. Models, features and limits may change. If we remove a paid feature you depend on, we'll tell you in advance and, where it's fair, offer a pro-rated refund.

The open-source engine. The AnimSpark engine, film runtime and music engine are published on GitHub under the Apache License 2.0. Your use of that code is governed by its licence, not these Terms, and it needs no account.

3. Your account

• You must be at least 13, or the minimum age for using online services without parental consent where you live. If you're under 18, a parent or guardian must agree to these Terms for you.
• Give accurate information, keep your sign-in secure, and tell us promptly at [email protected] if you think someone has used your account without permission.
• An account is for one person. Don't share it or sell it. API keys are secrets. You're responsible for what's done with them, so revoke a key you think is exposed.
• You can't use the Service if you are barred from it under applicable law, including sanctions laws.

4. Plans, credits and payment

Credits. Making films uses credits. A film is charged for what it actually used, with no minimum, and if nothing ran, nothing is charged. Every plan buys credits at the same rate, shown on our pricing page. Credits have no cash value, can't be transferred, and can be used only on the Service.

Subscriptions. Paid plans renew automatically, monthly or yearly, until you cancel. Credits arrive every month, on yearly plans too. Unused subscription credits stay usable for one more month, then expire. Credits you get once, such as signup credits, don't expire. Credit packs, where we offer them, don't expire either.

Changes to your plan. Upgrades apply immediately, and you pay only the pro-rated difference. Downgrades and cancellations take effect at the end of the current period, and you keep your plan until then. You can cancel at any time in your account's billing settings.

Payment. Payments are handled by our payment processor. You authorise us to charge your payment method for your plan and any taxes each period until you cancel. Prices are in US dollars and exclude taxes unless we say otherwise. If a payment fails, we may pause paid features until it succeeds.

Price changes. We'll give you at least 30 days' notice before a price change applies to your subscription. The new price starts at your next renewal after the notice period, and you can cancel before then.

Refunds. Our Refund Policy explains when you can get your money back. Nothing in these Terms limits refund rights you have under consumer law. If a request fails because of a problem on our side, the credits it used are returned.

5. Your content

You own it. “Input” is what you give the Service: prompts, messages, files, links, voices and footage. “Output” is what the Service makes for you from your Input. As between you and us, you own your Input and your Output. To the extent we have any rights in your Output, we assign them to you.

The licence you give us is narrow. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display your Input and Output. We use it only to provide the Service to you: running the agent, storing and syncing your projects, rendering your films and serving the share links you create. The licence also covers passing content to the providers in our Privacy Policy for those purposes. It ends when you delete the content or your account, except for copies in backups kept for the short period the Privacy Policy describes.

What we don't do. We don't use your Input or Output to train AI models, we don't sell it, and we don't publish it or use it in marketing without your explicit permission.

Your promises. You confirm that you have the rights your Input needs, including any rights from people who appear or are heard in it, and that your Input and your use of Output don't break the law or these Terms.

6. AI Output

• Check it. Output is made by AI and can be inaccurate, incomplete or unexpected. Review it before you publish or rely on it, especially for facts, figures, names and anything legal, medical or financial. Output isn't professional advice.
• It may not be unique. Others may get similar Output from similar requests. Your ownership covers your Output, not other people's.
• Third-party material. The agent may use material from our library, such as fonts, sound effects and templates, or material it finds for you, such as stock footage or pages from links you give it. Library material comes with the right to use it in your films. For material found on the web, you're responsible for making sure your use is allowed.
• Label it where required. Some places and platforms require AI-generated media to be disclosed. Follow those rules when you publish.

7. Acceptable use

Don't use the Service to:

• break the law or help anyone else break it;
• create or share child sexual abuse material, or any sexual content involving minors (we report it to the authorities);
• depict a real person in sexual content, or in a way designed to deceive, without their consent;
• clone or imitate a real person's voice or likeness without their permission;
• harass, threaten, defame or incite violence or hatred against anyone;
• deceive people: impersonation, fraud, scams, or false content meant to mislead people about elections, public health or emergencies;
• infringe intellectual property, privacy or publicity rights;
• create malware or spam, or attack or disrupt any system, including ours;
• get around credit charges, rate limits, or security or safety measures, or access the Service by automated means other than our API and supported agent integrations;
• copy, resell or reverse-engineer the Service. The open-source code is yours to use under its licence.

We may remove content or restrict features to enforce these rules. We act in proportion to the problem, and where we can, we tell you what happened and why.

8. Coding agents and third-party services

You can connect coding agents such as Claude Code or Codex to AnimSpark for Mac. Those agents run under your own account with their provider, and their use is governed by that provider's terms and pricing. We're not responsible for them, but when they ask AnimSpark for generated media, that use is charged in credits under these Terms. The same applies to other third-party services you connect or link to.

9. Sharing and publishing

A share link lets anyone who has it watch the film and see its prompt. You decide who gets it, and you can add a password or an expiry date, or stop sharing at any time. Once people have downloaded a film, we can't take it back. Publishing a Mac project to the cloud copies it to your account so it can be shared. The folder on your Mac stays the original.

10. Our rights and your feedback

Except for your content and the open-source code, the Service, including its software, design, library, models and brand, belongs to AnimSpark and its licensors. We give you a personal, non-exclusive, non-transferable licence to use the Service, including installing AnimSpark for Mac on devices you control, while you follow these Terms. The Mac app updates itself, and updates install only when you agree. Don't use our name or logo in a way that suggests endorsement without our permission.

If you send us ideas or feedback, we may use them without obligation to you. This doesn't give us any rights in your content.

11. Copyright complaints

If you believe content on the Service infringes your copyright, write to [email protected] with: your contact details; the work you believe is infringed; where the content is (for example the share link); a statement that you believe in good faith the use isn't authorised; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorised to act for the owner. We respond to valid notices, may remove the content, and end the accounts of repeat infringers. If your content was removed by mistake, you can send us a counter-notice.

12. Suspension and termination

You can stop using the Service and close your account at any time. The Privacy Policy explains how.

We may suspend or terminate your access if you seriously or repeatedly break these Terms, if the law requires it, or to protect people or the Service. Except in urgent cases (serious harm, illegal content, a legal requirement or a security threat), we'll warn you first and give you a chance to fix the problem. If we terminate your account for reasons other than your breach, we'll give you at least 30 days to download your films and refund any prepaid, unused part of your subscription.

Sections 5 (your promises), 6, 10, 13, 14, 15 and 16 continue after termination.

13. Disclaimers

We work hard to make AnimSpark reliable, but the Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service or Output will be uninterrupted, error-free or accurate. Keep your own copies of films that matter to you.

14. Limitation of liability

To the fullest extent the law allows, neither AnimSpark nor its suppliers will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$100.

These limits don't apply to liability that can't be limited by law, such as for death or personal injury caused by negligence, fraud, or gross negligence or wilful misconduct. If you're a consumer in the EEA or the UK, you keep all your statutory rights, and we're responsible for foreseeable loss caused by our breach of these Terms.

15. Indemnity

If you use the Service for business, you'll defend and compensate AnimSpark against third-party claims that arise from your Input, from how you use Output, or from your breach of these Terms. This doesn't apply to consumers, or to claims caused by our own breach.

16. Disputes and governing law

Talk to us first. Most problems can be solved quickly at [email protected], and we'll try in good faith for at least 30 days before either of us goes to court.

These Terms are governed by the laws of the place where AnimSpark is established, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring claims in its courts.

17. Changes to these Terms

We'll update the date at the top when we change these Terms. If a change is material, we'll tell you by email or in the app at least 30 days before it takes effect, unless it's needed sooner for legal or security reasons. If you don't agree to the new Terms, you can close your account before they take effect. Changes never apply to disputes that arose before them.

18. General

These Terms, together with the Privacy Policy, the Refund Policy and any terms shown when you buy something, are the whole agreement between us about the Service. If part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it. You can't transfer these Terms without our consent. We can transfer them as part of a merger or sale, and your rights won't be reduced. Neither of us is responsible for delays caused by events beyond reasonable control.
